Abstract

The scientific article is devoted to the research of electronic dispute resolution in the sphere of Internet and IT technologies. The main stages of the state legal settlement and legal aspects on the example of domestic and foreign countries are considered, with regard to the feasibility and relevance of the implementation of an alternative dispute settlement mechanism.

The purpose of the article is to review and introduce the possibilities of state and legal settlement of online disputes.

It is noted that the development of market mechanisms contributes to the correction of state-legal and social-legal relations, which still remain partially unregulated. These are relationships related to online and online commerce, online gaming, social networking, software rights transfer through online services and websites.

State-law instruments based on the example of a regulated platform are analyzed, as well as approaches to building the structure of the legislative base on the example of foreign countries.

Attention is drawn to the fact that it is through jurisprudence to develop and apply negotiation and mediation techniques that it is an effective legal instrument that gives citizens greater access to justice.

Alternative dispute resolution (hereinafter - ADR) has been found to be used successfully in foreign countries, show significant results in the resolution of legal disputes, and help offload national courts. ADR is a socially necessary tool in the arsenal of litigation ttools For effective use of ADR in Ukraine, it is necessary not only to formally introduce such methods at the legislative level, but also to understand their essence and content. In this regard, an up-to-date study of each ADR element appears.
