PUBLIC ADMINISTRATION IN THE SPHERE OF CIVIL DEFENSE: FURTHER IMPROVEMENT OF THE LEGISLATION UNDER THE CONDITIONS OF THE STATE OF MARTIAL

Abstract

The Russian-Ukrainian war, which began on February 24, 2022, also became a test for the unified state civil defense system, whose functional and territorial subsystems were already on the highest level of readiness on the first day of the introduction of martial law. The purpose of the research is to conduct an analysis of the further improvement of national legislation in the field of civil protection under the conditions of martial law. Considered some scientific studies in the direction of studying the problems of legislative regulation of civil protection issues in the pre-war period, in particular, amendments to the Code of Civil Protection of Ukraine. For the first time, the content of normative legal acts regulating the functioning of the unified state system of civil protection and adopted under the conditions of martial law was analyzed. Special attention was paid to the issues of demarcation of powers between central executive bodies in the field of civil protection, activities related to civil protection during the period of martial law; implementation of norms of international humanitarian law in the field of civil protection; creation and use of material reserves; anti-mine activities; voluntary formations of civil protection, etc. Based on the changes in the legislation, the main areas of improvement of state administration in the field of civil protection, organization of civil protection, additional measures taken at the central, regional and local levels are defined. The main research methods are defined as: abstract-logical; synthesis and modeling. Some results of the implementation of the requirements of the law in the conditions of martial law are systematized. It was established that there is an urgent need for further regulatory and legal regulation of civil protection issues, taking into account the actions of central and local authorities under martial law. Attention is focused on the fact that in the future it is expedient to carry out in-depth scientific research on the practical implementation of the requirements of current legislation in the field of civil protection in wartime conditions, the implementation of state administration in the field of civil protection in wartime conditions, the functioning of a unified state system of civil protection during martial law in Ukraine.
